We accept major credit and debit cards and other payment methods as displayed on the Site at the time of checkout. You represent and warrant that you have the legal right to use any payment method you submit in connection with an order.

5.2 Order Confirmation

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order at any time for reasons including, but not limited to, product availability, errors in pricing or product descriptions, or suspected fraud. If your order is cancelled after your payment has been processed, we will issue a refund to your original payment method.

5.3 Refunds and Cancellations

Our refund and cancellation policy is as follows:

  • Orders may be cancelled prior to preparation. Once an order has entered the preparation stage, cancellation may not be possible.

  • THE RESULTS OBTAINED FROM THE USE OF THE SITE OR SERVICES WILL BE ACCURATE OR RELIABLE;

7. Limitation of Liability

IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF TACO TIME TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO TACO TIME IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

The limitations of liability set forth in this Section apply regardless of the theory of liability, whether based in contract, tort (including negligence), strict liability, or otherwise, even if Taco Time has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so some of the above limitations may not apply to you.


8. Indemnification

You agree to defend, indemnify, and hold harmless Taco Time and its officers, directors, employees, agents, licensors, service providers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your use of the Site or Services, including but not limited to any data submitted by you;
  • Your violation of any third-party rights, including but not limited to any intellectual property rights or privacy rights;
  • Your violation of any applicable federal, state, or local laws, regulations, or ordinances;

10. Dispute Resolution

10.1 Informal Resolution

We will attempt to resolve the dispute informally within thirty (30) days of receiving your written notice. If we are unable to resolve the dispute informally within that period, either party may pursue the dispute through the formal processes described below.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except for claims for injunctive or other equitable relief, you and Taco Time agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Site, or the Services shall be resolved by final and binding arbitration, rather than in court, pursuant to the rules of the American Arbitration Association (AAA) Commercial Arbitration Rules, which are available at www.adr.org. 10.3 Class Action Waiver

YOU AND TACO TIME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Taco Time agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

10.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or other proprietary rights.


11. Term and Termination

These Terms shall remain in full force and effect while you use the Site or Services. We reserve the right, in our sole discretion, to:

  • Suspend or terminate your account or access to the Services at any time, with or without cause, and with or without notice;
  • Refuse service to any person or entity for any reason;
